Jan 2007:
Modification of Child Support:
I represented a party who was seeking a reduction in child support based on the reduced income from the party's business over the past several years. The opposing party did not want the reduction and disbelieved that the business income reduction was valid. I was able to prove the loss of income in the business and obtained a reduction in our party’s child support obligation.
Custody Issues:
The opposing party obtained emergency custody of the children even though our party had a valid custody order. Allegations were made that the children were in immediate danger in the custodial parent’s care. After a hearing in Washington County, the court decided in my client’s favor that the children should be returned to the custodial parent because they were not in immediate danger.
Settlements:
During the month of January, most of my cases were out of court, including 5 cases which were settled prior to trial. One was settled after depositions, one was settled in private mediation, two were settled at court before the trial, and one was settled in negotiations between attorneys over several days.
